Terms and Conditions for Consumers
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND KEEP A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
1. Format of the Contract

1.1 These terms and conditions apply to CONSUMERS ONLY and do not apply to goods purchased for commercial use by organisations such as businesses and educational or government establishments.

1.2 These terms of sale apply to all goods supplied by JD Airsoft Limited, whose registered Address is at Unit 5 Virage Park, Green Lane, Cannock, Staffordshire, WS11 0NH, registered in England number 6643770.

1.3 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Acceptance of your order will be communicated to you by way of email at the point of dispatch of the products. Acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time the Supplier sends the e-mail to you (whether or not you receive that e-mail).

1.4 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until the Supplier has shipped your order.

1.5 The contract is subject to your right of cancellation (see below). 

1.6 The Supplier may change these terms of sale without notice to you in relation to future sales.

2. Description and price of the goods 

2.1 The description and price of the goods you order will be as shown on the Supplier's website at the time you place your order. All velocities quoted on product pages are approximate and should be used as guidance only. Batteries, slings, speed loaders and chargers included with electric products are not covered under warranty as they are regarded as 'free' items.

2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. 

2.3 Every effort is made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. 

2.4 In addition to the price, you may be required to pay a delivery charge for the goods.

2.5 The Supplier warrants that the goods will at the time of delivery correspond to the description given by the Supplier. It is your responsibility to check the compatibility and suitability of goods for any particular purpose before ordering. The Supplier reserves the right to make without notice such minor modifications in specifications, designs or materials as it may deem necessary or desirable by experience.

2.6 Product images shown may represent a range of products or be for illustration purposes only, and may not be an exact representation of the product. This does not make the product 'faulty or not as described'. JD Airsoft Ltd does not consider product colour variations as a valid "Item Not as Described" reason.

3. Payment

3.1 Payment for the goods and delivery charges can be made by any method shown on the Supplier's website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be of the essence. 

3.2 There will be no delivery until cleared funds are received. 

3.3 Payments shall be made by you without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you.

3.4 Payments placed online through PayPal, if cancelled you enter into the PayPal T+Cs *see Point 16 PayPal Refund

4. Delivery 

The goods ordered will be delivered to the billing address that your give when you place your order. The order details cannot be changed once the order has been placed. Orders will be shipped to the billing address unless you are using a UPS Access point. (see 4.5) or unless agreed between customer and retailer. If this is required, please EMAIL before placing the order or as soon as you have placed the order. 

4.1 We will endeavour to despatch your package within 24 hours although at peak times this may take slightly longer.

4.2 Couriers delivery is Monday to Friday between the hours of 8am and 6pm (0800 - 1800 hours GMT) except for holidays. So if your order on a Friday it will be Monday, unless it is a bank holiday which would move to Tuesday. We do not directly control the couriers and we cannot obtain a specific delivery time from them. Delivery may be delayed by extreme weather or road conditions. It may take longer if there are any additional security checks that we have to do eg UKARA confirmation from yourself or a third party. 

4.3 We do not offer a Saturday delivery.

4.4  If you deliberately fail to take delivery of your order the without prejudice to any other right or remedy available to the supplier may:

store the goods until actual delivery and charge your for reasonable cost (including insurance) of storage

or

sell the goods at the best obtainable price (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed for the goods or charge you for any shortfall below the agreed to pay for the goods.

Cost of Delivery:

4.5 The cost of delivery will be added to your order total. You can select your preferred method of delivery from the options displayed at the checkout. Please select the correct option to ensure that your order is not delayed. We reserve the right to adjust shipping methods and costs but this is usually done in your favour and you will be informed by email or telephone.

4.6 We offer a next working day delivery and UPS access point. The UPS access point requires the customer to travel to the access point to make the collection. UPS will contact you when your delivery has arrived at the access point. To find out any information you may need on UPs access points here > UPS Access Point 

In addition to this, if our courier cannot deliver goods to a premises and the goods are returned to JD Airsoft Ltd then the customer will be charged for the delivery back to JD Airsoft Ltd and then charged for a second delivery.

4.7 Important

All deliveries must be checked by the receiver (customer) BEFORE signing for them. If the package is damaged in anyway either refuse to accept delivery or ask the delivery person to check the contents with you. You should only sign for the goods if you are satisfied. In any other circumstances, please sign the package receipt as "not checked". If a customer fails to follow this and a package is signed for as received in good condition. We may find it difficult (or impossible) to claim compensation in this case.

4.8 Where we ship:

We do not ship outside of mainland UK.

Standard UK shipping will be sent UPS (Maximum size length 1 metre / max 25kg). Items over 1 metre in length occur a 'large item' charge of £8.50.

5. Collect In-store

5.1 If you have placed an order with us that is collect in-store, you are required to bring some form of ID to collect your order.

5.2 If you are unable to come and collect your order and wish to send someone to collect it for you, please email us with your Order Number and the Name of the person that is collecting for you, and they are required to bring ID to collect the order.

6. RISK/TITLE

6.1 The goods are at your risk from the time of delivery.

6.2 Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:

  6.2.1 the goods, and

  6.2.2 all other sums which are or which become due to the Supplier from you on any account.

6.3 The Supplier shall be entitled to recover payment for the goods not withstanding that ownership of any of the goods has not passed from the Supplier.

7. Right to Cancel 

7.1 The terms and conditions of sale detailed below are provided for your information, in line with legislation contained in The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This legislation covers items bought where there is no direct contact between the Supplier and the consumer. It does not apply where goods are bought for business use, from showrooms, fairs or exhibitions.

7.2 You have the right to cancel this contract within 14 days without giving any reason.  Please note, this right to cancel does not include personalised items, such as (but not limited to) two-tone; engraving etc.  Personalised items can only be returned if a fault is found, or if the requested personalisation does not meet an acceptable standard. 

6.3 The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

7.4 To exercise the right to cancel, you must inform us [JD Airsoft LTD Unit 5 Virage Park, Green Lane, Cannock, Staffordshire, WS11 0NH; Tel: 0845 600 5144] of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, or e-mail).

7.5 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

8. EFFECTS OF CANCELLATION 

8.1 We will make the reimbursement without undue delay, and not later than

  (a)14 days after the day we receive back from you any goods supplied, or

  (b) (if earlier) 14 days after the day you provide evidence that you have returned the item/s or

  (c) if there were no item/s supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

8.2 We will make the payment using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the payment.

8.3 We may withhold repayment until we have received the item/s back or you have supplied evidence of having sent back the item/s whichever is the earliest.

8.4 You shall send back the item/s or hand them over to us in store without undue delay and in any event not later than 14 days from the day on which you contacted us, to say you wish to cancel your order with us. You have to do this before the 14 days expire. 

9. RETURNS

9.1 If you are looking to return any item/s that have purchased from us online, said item/s should be returned to us with the original packaging along with your receipt. 

9.2 Unwanted items are subject to a 14 day return policy for online orders only. The 14 days begin on the day you receive delivery of the item/s. Return costs are covered by the buyer unless otherwise faulty. We do not offer a returns policy for unwanted items purchased from our retail store. Your original shipping costs will not be reimbursed for unwanted or wrongly ordered items.

9.3 If you are looking to return any item/s that you have purchased from us online you are required to compete a return's form  > https://jdairsoft.net/returns and our team will handle the return from there.

9.4 If your item/s are suspected faulty within the warranty period we will email you a return label.

9.5 When you are returning your item(s) back to us here at JD Airsoft, you are liable for any diminished value of the goods, you are required to package the item/s in a suitable amount of packaging, so the box and item/s do not get damaged.

9.6 You will be required to bear the direct cost of returning the goods, if we do not see that the item(s) are faulty or not fit for purpose or ordered in error.

9.7 We would like to recommend that you use the following packaging requirements that our courier (UPS) recommend

•A rigid box

•Remove any labels, hazardous materials indicators, and other previous shipment markings on the box that are no longer applicable

•Wrap all items separately 

•Use adequate cushioning material

•Use strong tape designed for shipping

•Do not use string or paper over-wrap

•Use a single address label that has clear, complete delivery and return information, Place a duplicate address label inside the package.

If you DO NOT use the adequate packaging, you may not be issued a FULL refund, as you have not followed our business T&Cs. 

9.8 Once a Two Tone Order has been Two-Toned we can no longer accept return of the item, this is because the item has been modified from its original state.

Please ensure before ordering that you are 100% happy with your purchase to avoid disappointment. Don't forget, you can always visit our Retail Store to try the item before you buy them. If the item develops a fault or stops working due to a manufacturer error we can look into fixing the product for you.

10. Warranty 

10.1 All goods supplied by the Supplier are warranted free from defects for 6 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer. 

10.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier's instructions, or any alteration or repair carried out without the Supplier's approval. 

10.3 If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing via the e-mail address or Tel: 0845 600 5144 within 2 working days. 

10.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the Supplier in writing via the e-mail address or Tel: 0845 600 5144 as soon as possible, but in any event within 7 days of the date you discovered or ought to have discovered the damage, defect or complaint.

11. Limitation of Liability 

11.1 the Supplier's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. 

11.2 Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation. 

12. Data Protection 

12.1 Every online purchase you make from our store is a secure transaction. Our site uses the strongest commercially available level of encryption, 128-bit Secure Socket Layer (SSL). This ensures that your transactions are secure and your information cannot be hi-jacked or redirected to anyone but us. However, as no data transmissions over the Internet can be guaranteed to be 100% secure, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

12.2 Save as provided below, we will not sell, distribute or disclose information about you as an individual or your personal usage of the Site (‘Information’) without your consent or unless required or permitted to do so by law. The Information we gather may include name, delivery address, credit or debit card number and expiry date, email address, telephone number, and any personal preferences.

12.3 Please note that we do provide links to other sites, which may not be governed by this Privacy Policy and you should view the particular privacy policies of those sites for further information.

12.4 In addition to the Information which you supply to us, information and data may be automatically collected through the use of cookies. Cookies are small text files the Site can use to recognise repeat users and allow us to observe behaviour and compile aggregate data in order to improve the Site for you. For example, cookies will tell us whether you viewed the Site with sound or with text on your last visit. Cookies also allow us to count the number of unique and return visitors to our Site.

12.5 Some of our associated companies may themselves use cookies on their own websites. We have no access to, or control of these cookies, should this occur. Unfortunately, we cannot accept liability for any malfunctioning of your PC or its installed web browser as a result of your seeking to follow these instructions.

12.6 We may use the Information we gather to notify you about important functionality changes and alterations to the Site, or offers of products, services or information that might be of particular interest to you. Your information may also be transferred to another company in the event of sale of our company to a third party. In that event, we will endeavour to ensure that your rights and freedoms in respect of the processing of your personal data are adequately and appropriately protected. By submitting your Information and ticking the requisite boxes on any order form or when subscribing to the services available on our Site, you consent to such use and transfer. If at any time you wish to stop receiving our newsletter or any other information you may have requested from us or any other company, please email or write to us at our registered address.

13. Applicable Law 

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract. 

14. Images

Product images are for illustrative purposes only. 

15. Promotions

Promotional items not claimed within 3 months of ordering may be lost, no alternative will be offered in such circumstances.

16. Age Restrictions & purchasing Realistic Imitation Firearms.

You agree to be of legal age to purchase and/or use any product that must adhere to official or recommended age ratings. Please note that you must be 18 years or over and be a registered skirmisher  / re-enactor to purchase RIF's from the JD Airsoft online store.

There are legal requirements in the UK about owning a replica imitation firearm and it is ILLEGAL for anyone without a 'VCRA exemption' to purchase one. To purchase a RIF you must have 'reasonable cause' and be either:

1. An active airsoft game participant and registered at your local Airsoft skirmish site / club and be able to verify your membership. Your registration can either be a private scheme run by your site/club or through the UKARA national player registration database. To purchase a realistic replica firearm, you MUST HAVE a VALID SITE/CLUB or UKARA player number. You do NOT have to be UKARA registered, although recommended their national database system is a lot more reliable and quicker than trying to get your membership verified by by a third party.

2. A film, TV or theatre production company who needs a realistic firearm for the purpose as a prop. Written evidence must be supplied before any purchase.

3. A Crown Servant who requires a RIF for the purpose of carrying out their duty. This would be for training or similar and again will require written documentation as proof of purpose.

4. A military re-enactment member who requires a RIF for demonstration, prop, show or vehicle mounting in order to present a realistic and believable weapons display whilst carrying out their duties as a member of the re-enactment group. Third-party liability insurance is a legal requirement. Proof of VALID membership and insurance must be provided.

In the event that you are not registered with any of the above, you are still able to buy a two-tone “two tone” airsoft product over the age of 18 years of age.

17. Force Majeure

The Supplier will not be under any liability what so ever in the event that the Supplier is prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond the Supplier’s control. These events include acts of God, civil commotion, riots, flood, drought, fire, legislation or any acts by third party companies or individuals not either under contract to or employed by the Supplier.

18. PayPal Fee on Refunds

PayPal have announced the PayPal Policy updates due to come into effect on the 5th of March 2020. PayPal reserve the right not to return fees on refunds. As of Thursday the 5th of March 2020 PayPal will start to retain all fees from transactions that we refund. If you have made a payment with PayPal we will not be returning the fees if a refund has been requested.

19. Privacy

(see 10.5) Most browsers are automatically set to accept cookies. But, if you wish, you can configure your browser to restrict cookies or block all cookies by changing your browser settings. If you wish to block all cookies you may experience difficulties in the operation of our website.


20. Pyrotechnics

By purchasing smoke or pyrotechnics I understand the conditions of sale & use. JD Airsoft Ltd reserve the right to share information if contacted by the police should misuse of these products take place. 

It is illegal to use smoke grenades or any form of pyrotechnics in sports stadiums in the UK. Over 18 use and supply only. Do not use products indoors or in confined areas. Smoke can cause breathing difficulties. Do not use pyrotechnics in public places unless permission is sought. Do not use pyrotechnics in locations which could create panic or concern. I have read and understand that pyrotechnics can only be used in controlled areas or on private land and can confirm that I understand these conditions.
